Step 2 of 5

How you own it

A deed can only pass what you own, the way you own it. These answers decide who has to sign.

Who is named as the owner on your current deed?
Will each owner sign personally?

Answer no if someone will sign for an owner under a power of attorney or as a guardian.

Does each owner understand what this deed does and want to sign it?

The person signing must understand they are naming who receives the property at their death. If dementia or illness makes that uncertain, talk to an elder law attorney first.

Is there a mortgage or home equity loan on the property?
Is any owner on Medicaid for nursing home or long-term care, or applying for it?

Medicaid has its own rules about property transfers. We can't tell you how a deed affects an application.
