Terms of Service

These terms govern your use of Simple Lady Bird Deed at https://simpleladybirddeed.com (the "Service"), operated by Owusu LLC ("we", "us"). By using the Service you agree to them.
The Service
Simple Lady Bird Deed is self-help software. You answer questions, and the software fills a fixed deed template for Florida or Michigan with your answers and gives you general instructions for signing and recording it. Simple Lady Bird Deed is not a law firm and is not a substitute for the advice of an attorney. Using it does not create an attorney-client relationship, and no one at Simple Lady Bird Deed reviews your deed or gives you legal advice. You choose what your deed says and you are its preparer. You are responsible for checking that it is correct and right for you, including that the legal description and names match your recorded deed, before you sign and record it. We do not record deeds and do not promise that a county will accept one, or what a deed will mean for your taxes, Medicaid or any other benefit.
If your situation is unusual or you are unsure whether a lady bird deed is right for you, talk to a real estate or elder law attorney licensed in your state.
Accounts
You sign in with an email link. Keep access to your email secure: anyone who can read it can sign in to your account. You must be at least 18 years old.
Price and payment
The questions and the review are free. A deed is a one-time payment, charged through our payment processor, Stripe, in US dollars. There is no subscription and nothing renews. One payment covers one deed for one property and its owners (the state, county, parcel number, legal description, owners and how they own it, as they are when you pay; typo fixes are allowed). You may change other answers, such as beneficiaries and addresses, and download the deed again. A deed for another property needs its own payment.
- Refunds. The deed is digital content made available as soon as you pay. Payments are not refundable except where the law requires it. If a charge is refunded or disputed, access paid by it ends.
- Taxes. Prices may not include taxes, which are added where required.
Your content
You keep all rights to the information and files you put into the Service. You give us permission to store and process them only to run the Service for you. A deed you upload to be read is sent to our AI provider to read it and is not kept. Do not enter Social Security numbers: a deed doesn't need them.
You can delete your account at any time from the Account page. When you delete it we delete your answers from the Service, except copies we must keep by law or that remain for a short time in backups.
Acceptable use
Use the Service only for property you own. If you help an owner use it, the owner must read the questions and make every choice, and the owner is the deed's preparer. Do not use it to prepare a deed for someone without their knowledge, to create misleading or fraudulent documents, to access other accounts or our systems without permission, or to scrape or resell the Service.
Availability
The Service is provided "as is" and "as available", without warranties of any kind, to the extent the law allows. We do not promise that it will be uninterrupted or error-free.
Liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, taxes, fees or benefits, arising from your use of the Service or a deed made with it. Our total liability for any claim is limited to the amount you paid us for the Service in the 12 months before the claim.
Changes to these terms
We may update these terms. If a change is material we will tell you by email or in the Service before it takes effect.
Governing law
These terms are governed by the laws of the United States and of the state where Owusu LLC is organized, excluding conflict of laws rules, except where the law of the state where you live requires otherwise.
